Legal and Agreement
Terms of Service
Effective Date: October 5, 2026. Version 1.0. Draft prepared for public launch.
1. Acceptance of Terms
By accessing or using the Stick It Out website (stickitoutdrums.com), the member training portal (member.stickitoutdrums.com), or any associated software and computer vision coaching tools (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree with any part of these Terms, you must discontinue your use of the Platform immediately.
2. Platform Purpose and Free Tier
Stick It Out is an educational platform created by Michael Staus designed to help drummers build technique, speed, and endurance through structured rudiment training and motion analysis.
The core training platform, including the 40 standard rudiment exercises, adaptive metronome, medal progression system, weekly practice planner, and computer vision motion analysis, is provided completely free of charge.
No payment method or credit card is required to register or use the Platform. We reserve the right to introduce optional premium features or physical products in the future with clear notice.
3. User Accounts and Authentication
To save your practice logs and access the motion analyzer, you must create a member account using a valid email address. Authentication is handled via single-use magic login links sent to your email.
You are responsible for maintaining control over the email address associated with your account. You agree not to impersonate another person or misrepresent your affiliation with any entity.
4. Computer Vision Analysis and Uploaded Video Content
The Platform offers an optical motion analysis tool that processes video recordings of your drum practice to deliver coaching feedback:
- User Ownership: You retain full ownership and copyright of any video clips you upload or record through the Platform.
- Processing License: By submitting video recordings, you grant Stick It Out a non-exclusive, worldwide, royalty-free license to host, process, decode, and analyze the recording solely for the purpose of generating your performance metrics and coaching results.
- Retention and Automated Erasure: Uploaded video files are held in temporary storage and automatically deleted within 72 hours of processing. Derived performance statistics (such as tempo, score, and rhythm balance) are retained in your account history.
- Appropriate Content: You agree not to upload any video containing explicit, unlawful, defamatory, or infringing content.
5. Physical Exertion and Ergonomic Disclaimer
Practice Safety Notice
Drumming involves intense, repetitive physical movement of the hands, wrists, arms, shoulders, and legs. You are responsible for practicing within your physical limits, warming up properly, and using ergonomic technique. The Platform's automated coaching findings and drill suggestions are educational tools and do not constitute physical therapy, medical advice, or personalized ergonomic diagnosis. If you feel pain, numbness, or fatigue, stop practicing immediately and consult a qualified healthcare professional.
6. Acceptable Use and Platform Security
You agree not to engage in any activity that harms or disrupts the Platform:
- Do not attempt to access analysis jobs, videos, or records belonging to other members.
- Do not scrape, crawl, or harvest platform content using automated scripts.
- Do not reverse engineer, decompile, or extract the underlying models, computer vision pipeline, or backend APIs.
- Do not overload or flood our analysis servers or Cloudflare worker infrastructure.
Violations of platform security may result in immediate account termination.
7. Affiliate and Referral Program
The Platform provides an affiliate and referral program for creators and instructors:
- Attribution Rule: Referrals are tracked via first-party cookies with a 60-day attribution window. First attribution wins.
- No Self-Referrals: You may not use your own affiliate link to create multiple accounts or claim self-referrals.
- FTC Disclosure Compliance: Affiliates must clearly disclose their relationship with Stick It Out in accordance with Federal Trade Commission guidelines whenever sharing referral links.
8. Intellectual Property
The Stick It Out brand, logo, custom graphics, web design, curriculum structure, training algorithms, and motion analysis software are the exclusive intellectual property of Michael Staus and Blaze Digital Design. Standard Percussive Arts Society (PAS) rudiment definitions and public domain drumming patterns remain free for all drummers.
9. Account Termination and Erasure
You may permanently delete your account at any time directly through your Profile settings. Upon confirmation, your data will be immediately removed from our active database, object storage, and mailing lists.
We reserve the right to suspend or terminate accounts that breach these Terms, abuse platform resources, or engage in abusive behavior.
10. Disclaimer of Warranties and Limitation of Liability
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee uninterrupted availability, error-free operation, or that results from computer vision tracking will be 100% accurate under all camera angles and lighting conditions.
To the maximum extent permitted by applicable law, Stick It Out, Michael Staus, and Blaze Digital Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
